Terms of Service
Binding terms governing access to FundInsight institutional data services, API infrastructure, and research publications. Governed by Singapore law.
1. Agreement & Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between FundInsight Network Ltd. ("FundInsight"), registered at 10 Collyer Quay, #10-01 Ocean Financial Centre, Singapore 049315, and any individual or institutional entity ("User") accessing or utilising the FundInsight platform, data feeds, APIs, or research publications. By accessing this platform, the User represents and warrants that they are a professional market participant, accredited investor, or qualified financial entity as defined under the Securities and Futures Act (SFA) of Singapore or the equivalent regulatory framework in their jurisdiction. FundInsight reserves the right to terminate access to any User who misrepresents their professional status.
2. Permitted Use & Intellectual Property Licence
Subject to these Terms, FundInsight grants the User a non-exclusive, non-transferable, revocable licence to access and use the platform solely for internal institutional research, quantitative analysis, and decision-support purposes. The User expressly agrees not to: (a) redistribute, resell, or sub-licence any data or research derived from the platform; (b) use automated scraping or bulk extraction tools against platform infrastructure; (c) reverse-engineer, decompile, or disassemble any proprietary algorithm, model, or API component; (d) represent FundInsight data as independently generated without proper attribution. All intellectual property—including quantitative models, data methodologies, and research frameworks—remains the exclusive property of FundInsight Network Ltd.
3. Institutional API Access & Security
Access to institutional data tiers is governed by a separate Master Service Agreement (MSA) executed between FundInsight and the institutional client. FIX 4.4 API credentials are issued solely for purposes defined in the MSA. Unauthorised sharing of API credentials constitutes a material breach of these Terms and may result in immediate service suspension without refund. FundInsight employs rate-limiting, anomaly detection, and audit logging on all API endpoints. Users must notify FundInsight within 24 hours of any suspected credential compromise via security@fundinsight.net.
4. Risk Warnings & Disclaimers
The data, models, and research publications provided on this platform are for informational and research purposes only. They do not constitute financial advice, investment recommendations, or solicitations to engage in any financial transaction. RISK WARNING: Trading leveraged financial instruments carries a high level of risk and may not be suitable for all investors. You may lose more than your initial capital. FundInsight expressly disclaims all liability for decisions made on the basis of platform content. To the maximum extent permitted by applicable law, FundInsight's aggregate liability shall not exceed the total fees paid in the preceding twelve (12) months.
5. Service Availability & Force Majeure
FundInsight targets 99.9% platform uptime under normal operating conditions, as specified in the Service Level Agreement within each MSA. However, FundInsight does not warrant uninterrupted access and shall not be liable for service interruptions caused by force majeure events including natural disasters, telecommunications failures, cyberattacks, regulatory actions, or other events beyond reasonable control. Scheduled maintenance windows will be communicated to registered clients no less than 48 hours in advance.
6. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising from these Terms shall first be subject to 30 days of good-faith negotiation. Unresolved disputes shall be referred to binding arbitration under the Singapore International Arbitration Centre (SIAC) Rules, with proceedings conducted in Singapore in the English language. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
